The Sutor Group was engaged by Brutoco to evaluate a claim on this project that was prepared by Brutoco and provide expert testimony with respect to our results. Claim amount $1,280,400.
This project involved placement of a polyester concrete overlay of approximately 3/4-inch in depth on 3.7 miles of eastbound I-80. This was a state-of-the-art project. The overlay was placed with a modified Portland concrete paving machine. The job also entailed a significant amount of surface and joint cleaning using shotblasting, waterblasting, and sandblasting equipment. This was a unit priced contract.
The dispute involved contract interpretation as to the extent of surface and joint cleaning required; and the interpretation of the traffic control and routing specifications. There were also minor disputes concerning the state directed resin mixture for the polymer concrete and the state's contract interpretation as to the thickness of the concrete overlay.
Additional cost of traffic control labor and equipment. Additional costs for waterblasting and shotblasting. Disruption and lost productivity affecting the overlay paving. Additional mobilization and winterization costs. Contract extension costs for traffic control and extended home office overhead.
