Engagement Scope

The Sutor Group was engaged by Evergreen State Construction, Inc. to prepare a price proposal for equitable adjustment. We also provided expert testimony relating to the cost impacts of various changes that occurred on the project. Our claim quantification impacts totaled $1,913,709. We presented our findings as expert witnesses in a court proceeding.

Project description

The construction of a shopping center, including the construction of a Stockmarket Foods store (43,426 square feet). The construction of a Pay N' Save store (22,122 square feet). The construction of three shop buildings (43,139 square feet). The construction also included all site utilities for the shopping center totaling 973,856 square feet. Construction elements consisted of slab on grade; masonry and tiltup walls; roof truss system; structured steel canopy; mechanical and electrical.

Entitlement issues

Excessive changes in construction drawings, late delivery of contract documents and permits, error in plans and specification, differing site conditions, and accelerated performance.

Type of impacts

Labor impacts resulting from disruption and changes in work sequences. Extended contract performance costs for field and home office overhead, interest, and professional fee reimbursement.
